| One of the major banks in SA recently started requesting the NHBRC certificate if a house / residential unit changes ownership. Added if the property is less than 5 years old. This is a great thing for the housing consumer! |

| It goes without saying that once a NHBRC certificate exchanges hands, the chances of getting it back are very slim. Bare in mind that everybody wants to hold on to certain original documentation for a set amount of time. |

| Now that is where we come in again. We get the duplicate certificates and deliver it to the attorney who needs it. |

| Rules of thumb: |
|
| According to law, home builders must be registered with the NHBRC and every residential unit, mortgaged or not, must be enrolled with the NHBRC before construction starts. To be an “owner builder” one must, according to law, apply for it before construction starts. Be sure to obtain proof of the outcome of your application and deal with it accordingly. |

| The following highlights the Offences: |
|
- Section 10 of The Act: Failure to register with the NHBRC.
- Section 14 of The Act: Failure to enrol a new residential unit 15 days prior to construction.
- Section 18 of The Act: a) To finance or register a bond on a home without ensuring that the builder is registered with the NHBRC and that the residential unit has been enrolled with the NHBRC and that the fees to the NHBRC has been paid.
- Section 18 of the Act: b) Failure by the conveyance to ensure that the builder is registered with the NHBRC and that the new residential unit is enrolled with the NHBRC.
- Section 18 of The Act: c) Failure by subsidy provider to ensure that the builder is registered with the NHBRC and that the new residential unit is enrolled with the NHBRC.
- Section 19 of The Act: Obstructing the NHBRC inspectors from performing their duties.
- Section 21 of The Act: a) Withholding information and or giving false and or misleading information.
- Section 21 of the Act: b) Failure to declare late enrolments

| According to The Act there are several offences. Convictions of such offences are as follows: |
|
- A fine of up to R25 000 per conviction, or
- A 1 year imprisonment per conviction.
